By accessing or using the RexTek website at rextek.co ("Website") or purchasing any products from our store, you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you are prohibited from accessing or using this Website or purchasing any products from RexTek.

These Terms apply to all users of the Website, including browsers, customers, and merchants. RexTek reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Website following any changes constitutes your acceptance of the revised Terms.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the modem firmware or the Website or its content without express written permission from RexTek.

 

SECTION 3 — PRODUCTS & PRICING

RexTek sells professional-grade outdoor 5G and LTE modems and related hardware. Please note the following:

  • The Skywave X62 and related products are built on carrier-grade, open-box hardware that has been repurposed, rebranded, and loaded with RexTek firmware.
  • All products are sold as-is with respect to the original hardware. RexTek custom software and firmware are provided as described on the product page.
  • Product images are for illustrative purposes. Minor cosmetic variations may exist on open-box units.
  • Prices are subject to change without notice. All prices are listed in US Dollars (USD).
  • RexTek reserves the right to limit quantities and refuse orders at its sole discretion.

 

SECTION 4 — ACCURACY OF INFORMATION

We strive to ensure all product descriptions, specifications, and pricing are accurate. However, RexTek does not warrant that product descriptions or other content on the Website are complete, reliable, current, or error-free. If a product listed contains an error, we reserve the right to correct it and update or cancel any orders placed at the incorrect price.

 

SECTION 5 — BILLING & ACCOUNT INFORMATION

You agree to provide accurate, current, and complete purchase and account information for all orders. You agree to promptly update your account information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Our Website may contain links to third-party websites or services not owned or controlled by RexTek. RexTek has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites. The RexTek name, logo, Skywave product name, and all associated branding are the intellectual property of RexTek. All Website content, including text, graphics, and software, is protected under applicable copyright and trademark laws. RexTek products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. RexTek does not warrant that the products will meet your specific requirements or that they will be compatible with all carriers or networks.

 

SECTION 9 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, RexTek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or loss of data, arising from your use of our products or services.

RexTek's total liability to you for any claim shall not exceed the amount you paid for the specific product that gave rise to the claim.

 

SECTION 10 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless RexTek and its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your violation of any law or the rights of a third party.

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Pennsylvania.
